1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (the "Client", "you"), and Ana Malato (the "Coach", "we", "us", or "our"), concerning your access to and use of the anamalato.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site and/or enrolling in any of our coaching services (the "Services"), you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. Coaching Disclaimer and Health Acknowledgement

A. Not Medical or Psychological Advice

The Coach, Ana Malato, is a fitness and health coach, not a medical doctor, registered dietitian, or licensed mental health professional. The Services, including all information provided on the Site and through coaching sessions, are for informational, educational, and motivational purposes only. The coaching provided is not a substitute for medical diagnosis, treatment, therapy, or professional advice from a licensed physician, psychiatrist, or other healthcare professional.

B. Assumption of Risk

The Client acknowledges that participation in any fitness program, including physical exercise, involves inherent risks of injury. The Client voluntarily participates in these Services with the full knowledge, understanding, and appreciation of the risks involved. By purchasing and participating in the Services, you assume all risks for any injuries, losses, or damages that may occur as a result of your participation.

C. Client Responsibility

The Client agrees to consult with a physician or other healthcare provider before starting any new diet, fitness, or health program, especially if they have a pre-existing medical condition, are pregnant, or have any other health concerns. You agree to follow all safety instructions provided by the Coach and to discontinue exercise immediately and seek medical attention if you experience any pain, dizziness, shortness of breath, or other concerning symptoms.

3. Services and Payments

A. Service Description

The Coach agrees to provide the Services as described on the Site or in a separate written agreement (e.g., a coaching contract). Services may include, but are not limited to, 1:1 virtual or in-person coaching sessions, personalized workout plans, group coaching, nutritional guidance (non-clinical), on-demand classes, self-guided programs, workshops, masterclasses, and retreats. 

B. Fees and Payment

The Client agrees to pay the fees for the selected Services as specified on the Site or in a separate invoice. All fees are quoted in EUR. Payment must be made in advance of the service delivery unless otherwise agreed upon. We accept payment via credit and debit cards (Visa, Mastercard, American Express, Discover), digital wallets (Apple Pay, Google Pay), and buy now, pay later services like Afterpay, Clearpay, and Klarna.

4. Cancellation and Refund Policy

A. Service Cancellation by Client

  • One-on-One Sessions: Clients must provide at least 24 hours' notice to cancel or reschedule a one-on-one session. Failure to provide adequate notice will result in the session being forfeited and charged in full.

  • Programs: All 3-month coaching program sales are final and non-refundable. If the Client wishes to stop the program before the 3 months, they must provide at least 30 days’ notice.

  • Subscriptions: Client must provide at least 30 days' notice to cancel the subscription option plans - Inner Strength Circle and Circle of Autonomy. 

B. Refunds

  • No Refunds: Due to the personalized and proprietary nature of the Services and the immediate access to digital materials, all fees are non-refundable once the Service has commenced, except as required by law.

5. Intellectual Property Rights

A. Our Content

Unless otherwise indicated, the Site and Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. No part of the Site or Services and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

B. Limited License

Provided that you are eligible to use the Site, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use.

6. Privacy Policy

Your privacy is very important to us. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices. By using the Site or Services, you agree to be bound by our Privacy Policy.

7. Modifications and Interruptions

A. Modifications to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms and Conditions. You waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates.

B. Service Interruption

We cannot guarantee the Site or Services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site or Services during any downtime or discontinuation of the Site.
